New Delhi: The Supreme Court said on Tuesday it would examine the constitutional validity of the central government’s decision to allow a 10 percent set aside for the Economically Weakest Sections (EWS) in admissions and employment.

A five-judge Constitution bench, headed by Chief Justice Uday Umesh Lalit and Justices Dinesh Maheshwari, S. Ravindra Bhat, Bela M. Trivedi and JB Pardiwala said the court would decide the procedural aspects and related details on 6 and on September 13. , the hearing on the matter will begin.

The high court clarified that it would first examine EWS’s 10 per cent reserve on admissions and jobs, and then consider appeals against the Andhra Pradesh High Court’s ruling that struck down a local law granting the reserve to Muslims.

He noted that since issues overlap in the matter, he would address the EWS quota-related allegations first, followed by the appeals challenging the Muslim reservation.

The Center, through the Constitutional Amendment Law 103 of 2019, introduced the provision for the reserve of EWS in admissions and government jobs.

The court asked four lawyers, Kanu Agarwal, Shadan Farasat, Nachiketa Joshi and Mahfooz Nazki, to act as nodal advocates to ensure the smooth handling of the pleadings, including the filing of joint compilations. Nineteen petitions, including the Andhra Pradesh government’s appeal, challenged the high court’s verdict that overturned the Muslim reservation on admissions and employment in the state.

The high court said that Andhra Pradesh’s reservation of seats in educational institutions and appointments/posts in public services under the state’s Muslim Community Act, 2005, is unconstitutional and violates articles 15(4) and 16 (4) of the Constitution. .
